Rabbi Approves of Girl Inflicting Wounds for Modesty Reasons

A letter is sent from a college campus midrasha to an Ultra-Orthodox rabbi. The letter writer explains that a young Jewish woman on campus who is a counselor at a midrasha (מרכזת מדרשה) is becoming more devout, but her non-observant parents disapprove. She wants to wear long skirts for modesty reasons, but her parents have forbidden her from doing so. Ynetnews.com reports that the letter continued, “The young woman thought that if she inflicted wounds on her legs she could tell her parents that she is wearing a long skirt to cover the wounds.”

According to ynet news, the letter was sent to Rabbi Yitzchok Zilberstein, the son-in-law of prominent Rabbi Yosef Elyashiv, for his opinion. Shockingly, Rabbi Zilberstein approved of the young woman inflicting wounds on her own legs so she could dress modestly, wearing the long skirts her parents have forbidden.

If this story is authentic, it is quite troubling on many levels. The young woman is in college and should be able to determine what she wears on her own, without her parents’ consent. [The ynet News translation was erroneous. It said that she was a college student, but the Hebrew explains that she was a counselor in a midrasha (מרכזת מדרשה), meaning that she is likely a teenager.] It should never have gotten to the point where she feels compelled to do self-harm in order to wear modest clothes.

While the commandment to honor ones parents is competing with the young woman’s belief in modest dress, there is precedent in Judaism for disobeying ones parents if it leads to adherence of the law in other cases. But above all else, it is in violation of Jewish law to inflict harm on oneself. Inflicting wounds on oneself is a transgression of Jewish law. It would be religious malpractice if Rabbi Zilberstein actually condoned this practice.

According to the article in ynet news, the rabbi responded to the questioner writing, “She is allowed to inflict wounds on her legs in order to dress modestly and evade sin.”

There is already documented evidence that young women are self inflicting wounds at a high rate. Reports of intentional cutting and self mutilation among teens, especially young women, is shocking. In a November 2008 article in the Huffington Post, Leslie Goldman wrote about the growing epidemic of troubled Jewish teenage girls who are suffering from eating disorders and body image problems that lead to cutting themselves. I would presume Rabbi Zilberstein was not familiar with this crisis when he penned his response.

Ynet reports, “In his reply, the rabbi commended the student’s initiative, saying ‘the blood from the self-inflicted wound will atone for the people of Israel,’ adding that the coordinator should allow the student to commit the act.” The rabbi’s opinion is odd. In fact, it even calls to mind the sacrificial system of a bygone era in Judaism. When I first read Rabbi Zilberstein’s response I couldn’t help but notice that he seems to draw on Christian symbolism.

If there’s truth to this story and Rabbi Zilberstein in fact opined that this young woman in college should continue to inflict wounds on her body so that she’ll have an excuse to dress modestly in the face of her parents’ disapproval, then he owes an explanation for his warped logic. I understand and respect those who feel strongly about modest dress, but there are boundaries. No person in their right mind would grant approval for such a horrible act.

No Dog Got Stoned in Jerusalem

There are certain things that we all read on the Web that we find unbelievable. Not “unbelievable” as in “amazing,” but events that simply cannot be believed. Some of these crazy things have actually occurred as reported, but many are simply hoaxes. Thank God for websites like Snopes.com to debunk these myths.

Last week, my hoax detector was going off at full speed when I read on Yahoo! News that a stray dog was condemned to death, or stoned, by a rabbinical court in Jerusalem. The report in Yahoo! News was reprinted from the Israeli newspaper Maariv which reported that a stray dog wandered into a Beit Din (religious court) in the strictly Orthodox neighborhood of Mea Shearim in Jerusalem and refused to be moved. A judge on the Beit Din determined the dog was a reincarnation of a secular lawyer who died 20 years ago. The article claimed that the judges on the Beit Din then “decreed” that local children stone the dog to death. Once the story hit Yahoo! News it got picked up by the BBC where it was the most read story of the day.

Of course none of this actually happened. It was a joke. That’s right, a joke. However, with news items traveling the globe at lightning speed thanks to the Internet, this story was everywhere within an hour. The damage was done even though Maariv issued a correction and apology on its website, JTA released an article explaining that there was no stoning of a dog, and Yahoo! News took the story down. It was already re-posted on hundreds of websites around the world.

The religious court issued the following statement:

There is no basis for stoning dogs or any other animal in the Jewish religion, not since the days of the Temple or Abraham… The female dog found a seat in the corner of the court. And the children were delighted by it; there were hundreds outside the court. They are used to seeing stray cats but most have never seen a dog before. The only action we took was to dial the number of the Jerusalem Municipality to get the people in charge to take it away.

There was no talk of reincarnation, a lawyer has never been mentioned, either now or 20 years ago, and there was no stoning. Such inventions are a kind of blood libel, and we wonder why the inventor of the story did not continue to describe how we collected the blood of the dog to make our matzah.

The story, when circulated on Yahoo! News, attracted more than 1,800 comments, most expressing violent anger. Just another example of people believing the truly unbelievable on the Web. Maybe it’s time for the large news agencies to actually fact check before publishing on the Web.

The Food Truck that Drove Right Over Kosher Politics

Kosher certification in the nation’s capital has become much like everything else in D.C. – political and divisive. The Vaad Harabanim of Greater Washington has long had a monopoly on kosher certification and it doesn’t want to give up its stronghold anytime soon.

Over the past several decades, reports have surfaced of the Vaad refusing to certify sit-down restaurants as kosher because it will lead to socializing between single Jewish men and women (which could in turn violate strict Jewish law). The Vaad even insists on charging for its own certification on top of already established certifications. As Jay Lehman recently wrote to the editor of the Washington Post, “The Vaad has made it clear that other kosher-certifying authorities are not welcome in the area to supervise these establishments. In addition, all kosher meat and poultry wholesale suppliers who wish to sell to kosher establishments are expected to submit to Vaad supervision, even if they are already certified by another nationally recognized kosher certifier.”

These tactics, which seem to violate the Sherman Anti-Trust Act, have come to light as a result of the local D.C. Vaad refusing to grant a kosher certificate to Sixth and Rye, the new food truck run by the Sixth and I Historic Synagogue. Last year, the non-denominational congregation offered an iPad as a prize to the individual who came up with the synagogue’s next big idea. The winning submission was a kosher deli restaurant housed in a truck to jump on the country’s trend of food trucks that roll out at certain times as announced via a Twitter feed.

The main reason the synagogue leaders launched the Sixth and Rye food truck wasn’t because they thought D.C. needed another kosher restaurant (though it does), but rather to increase its out-of-the-building engagement with local Jews in the District. The plan was to run the food truck at lunch each Friday afternoon. Everything seemed to be in place after they found a truck to rent, arranged for it to be made strictly kosher, purchased the signage, and contracted with celeb “Top Chef” contestant Spike Mendelsohn. The only thing that kept Sixth and Rye from opening as planned was the local Vaad’s refusal to certify the truck.

The popular synagogue, which functions more like a Jewish center with no membership, only had the best of intentions. In creating Sixth and Rye, they were planning to reach out to young Jews and provide a delicious, kosher deli lunch to workers in downtown Washington. The Vaad, in refusing to certify the food truck as kosher, missed a great opportunity. Thankfully, along came a rabbi from Baltimore who agreed to give Sixth and Rye his hekhsher (kosher seal of approval).

Rabbi Y. Zvi Weiss, the Baltimore kosher certifier, essentially broke the Vaad’s monopoly when he gave the food truck his okay. Hopefully, this will demonstrate to Washington’s kosher observant community that alternative options to the Vaad exist. With more than one kosher certifying agency in our nation’s capital there will be more kosher restaurants and a price decrease on kosher food. The Washington Post article about Sixth and Rye painted a clear picture of the misperceptions in the kosher marketplace. It reported that a young Washington local called the Vaad Harabanim of Greater Washington and was told that they were not certifying the truck, sohe didn’t bother getting in line to order his deli lunch. If the Vaad doesn’t certify it, he was certain it couldn’t be kosher. Alternatively, he could have inquired about the food truck’s certification and then learned from Baltimore’s Rabbi Weiss about his supervision and standards thereby making an informed decision.

Unfortunately, the local Vaad in D.C. (and in many other communities around the country) has convinced people that only they have the power to pronounce what is kosher. This only leads to ignorance and knee jerk reactions. When I spoke to Esther Safran Foer, the director of Sixth and I, she told me that another Orthodox rabbi in town sent a letter of support to her. Not only that, but he promoted the kosher food truck on his Facebook page and then bought over a dozen sandwiches for the Torah class he teaches on Capitol Hill.

Kudos to Sixth and I Historic Synagogue for putting this innovative idea in motion. In addition to the convenience of kosher deli lunches once a week in downtown Washington, perhaps this food truck will jumpstart a national conversation to curtail the political nature of kosher certification. While these local Orthodox kosher certification agencies may enjoy their monopoly, some competition will be best for the consumers. Wouldn’t it be wonderful if in the future the only thing Sixth and I had to worry about with their food truck was whether they had enough challah on hand to serve the hundreds in line?

Another Altered Photo in Jewish Newspaper

While everyone is talking about the altered photo with Hillary Clinton in the Haredi newspaper Der Zeitung, there have been other examples of these ultra-Orthodox newspapers editing photographs to suit their purpose.

TIME Magazine reported on a poorly doctored photo of Prime Minister Benjamin Netanyahu’s cabinet from 2009 in the Israeli newspaper Yated Neeman. In the photo, two female Cabinet members, Limor Livnat and Sofa Landver, are replaced with men’s faces.

The faces belong to ministers Ariel Atias and Moshe Kachlon, who in the original photograph can be seen toward the periphery of the group (standing, second from left and second from right). As TIME explains, “In Yated Neeman‘s version of the image, they have been cropped out. Much of the newspaper’s readership consists of ultra-Orthodox readers who do not think it proper for women to serve in the government.”

Statement from Haredi Newspaper Regarding Hillary Clinton’s Photoshop Job

The Haredi Jewish newspaper Der Zeitung (sometimes spelled Der Tzitung) has issued a statement about its alteration of the official White House photograph that included Secretary of State Hillary Clinton and Audrey Tomason, the director for counter-terrorism.

I’m glad that Der Zeitung has issued a statement, but I’m STILL cancelling my subscription (I will keep the lovely tote bag though).

The White House released a picture showing the President following “live” the events in the apprehension of Osama Bin Laden, last week Sunday. Also present in the Situation Room were various high-ranking government and military officials. Our photo editor realized the significance of this historic moment, and published the picture, but in his haste he did not read the “fine print” that accompanied the picture, forbidding any changes. We should not have published the altered picture, and we have conveyed our regrets and apologies to the White House and to the State Department.

The allegations that religious Jews denigrate women or do not respect women in public office, is a malicious slander and libel. The current Secretary of State, the Honorable Hillary R. Clinton, was a Senator representing New York State with great distinction 8 years. She won overwhelming majorities in the Orthodox Jewish communities in her initial campaign in ‘00, and when she was re-elected in ‘06, because the religious community appreciated her unique capabilities and compassion to all communities. The Jewish religion does not allow for discrimination based on gender, race, etc.

We respect all government officials. We even have special prayers for the welfare of our Government and the government leaders, and there is no mention of gender in such prayers.

All Government employees are sworn into office, promising adherence to the Constitution, and our Constitution attests to our greatness as a nation that is a light beacon to the entire world. The First Amendment to the Constitution guarantees freedom of religion. That has precedence even to our cherished freedom of the press! In accord with our religious beliefs, we do not publish photos of women, which in no way relegates them to a lower status. Publishing a newspaper is a big responsibility, and our policies are guided by a Rabbinical Board. Because of laws of modesty, we are not allowed to publish pictures of women, and we regret if this gives an impression of disparaging to women, which is certainly never our intention. We apologize if this was seen as offensive.

We are proud Americans of the Jewish faith, and there is no conflict in that, and we will with the help of the Almighty continue as law-abiding citizens, in this great country of our’s, until the ultimate redemption.

This story (Hillary Clinton’s HarediGate?) has been the hot topic of the day. I have to agree with Shmarya Rosenberg of FailedMessiah who wrote, “there is no Jewish law mandating the removal of normally clothed women from pictures like this.” Refusing to publish photos of women in a newspaper is but one more example of extremist Jews being so scared of modernity that they erect high fences around Jewish laws to keep their adherents from from “harm.” Is it really better to misrepresent the truth and deceive people than to see a photo of a modestly clothed Secretary of State?

Hillary Clinton Removed from Iconic Photo by Hasidic Newspaper

A big hat-tip to Failed Messiah (who gave a hat-tip to Critical Minyan) for breaking the news that an Ultra-Orthodox Hasidic Jewish newspaper, Der Tzitung, has determined that the photo of top U.S. leaders receiving an update on the mission against Osama bin Laden was too scandalous.
What was so offensive about the image? U.S. Secretary of State Hillary Clinton was in the photo and, based on good intel, the editor of Der Tzitung discovered that she is a woman. The Hasidic newspaper will not intentionally include any images of women in the paper because it could be considered sexually suggestive. The iconic photo shows President Obama, Vice President Biden, and members of the U.S. National Security Team in the Situation Room of the White House. Secretary of State Clinton, wearing a long-sleeved suit jacket, sits with her hand over her mouth. I’m not sure how Der Tzitung determined this was a racy photo. Perhaps they just don’t like the idea of a woman with that much political power.
Der Tzitung Photophopped Hillary Clinton out of the photo, thereby changing history. To my mind, this act of censorship is actually a violation of the Jewish legal principle of g’neivat da’at (deceit). I wrote about this subject a year ago following the Flotilla debacle in Israeli waters outside Gaza when the Reuters news agency doctored photos that it published by removing weapons from individuals aboard the Mavi Marmara. The doctoring of photographs like this is referred to as “Fauxtograpphing.” I’m curious to hear how Der Tzitung responds to its attempt to remove Hillary Clinton from this iconic photo and thereby from this historic event.

Twins Beat Mets in Kosher World Series

The Minnesota Twins have never played the New York Mets in a World Series, but when it comes to having Kosher food at the ballpark the Twins win.

Kosher Sports Inc. had been the exclusive Glatt Kosher provider at Shea Stadium, the former stadium of the NY Mets, since 2006. In 2008, the and Kosher Sports Inc. announced a multi-year agreement for the kosher concession company to continue as the exclusive Glatt Kosher concessionaire at Citi Field, which opened in 2009. However, things haven’t gone so smoothly in this agreement.

Kosher Sports Inc. says its contract with the Mets allows it to offer its kosher food at every game at Citi Field, the New York Daily News reported. The Mets’ management, however, issued a ban on sales during the Jewish Sabbath — between sundown Friday and sundown Saturday. This is likely the first case of a Major League Baseball team being more strict on kosher standards than a kosher food supplier. (There are of course those who would contend that a Jewish person attending a baseball game and purchasing food there on the Jewish Sabbath may not be that punctilious about the kosher laws.)

So, the case was all set to be heard by a federal judge who was to decide whether a vendor can sell kosher food during Mets games on the Jewish Sabbath. However, that federal judge had to recuse himself from the case because he was seen wearing a Mets baseball hat during a break in the trial and once wore a necktie with the Mets team colors during the trial.

Things seem to be going much more swimmingly in the Midwest. Kosher food will be offered at Target Field for the first time. In Target Field’s second season as the Minnesota Twins’ home field, fans will be able to purchase Hebrew National hot dogs and all the fixings from a strictly kosher card behind home plate.

My friend and colleague, Rabbi Avi Olitzky of Beth El Synagogue in St. Louis Park will provide the kosher certification and supervision. I was honored to provide some counsel to Rabbi Olitzky when he launched his kosher certification agency, MSP Kosher, a year ago. It’s wonderful to see other Conservative rabbis in the kosher certification arena, helping to create more options for the kosher consumer while maintaining strict standards, transparency, and sound business ethics.

The Star Tribune reports that “The cart will still be open Fridays and Saturdays but won’t be supervised.” I’m glad to see the Twins organization is not causing the same ruckus that led the Mets to a courtroom where Kosher Sports is seeking $1 million for breach of contract.

Congratulations to Rabbi Olitzky for bringing kosher hot dogs to the ballpark in Minnesota and to the Minnesota Twins for not messing up a good thing.

The Daily Show Raises the Eruv

There are certain obscure laws in Judaism that one doesn’t expect to be explained and debated on Comedy Central. Certainly the “legal fiction” known as an eruv is one of these.

According to Jewish law, a Jewish person is forbidden from carrying (or even pushing a baby stroller) from one domain to another on the Sabbath or Jewish holidays. There are actually several types of eruvin (plural) that allow Jewish people to circumnavigate what is forbidden on Shabbat, including the eruv tavshilin that allows us to cook meals for Shabbat on Jewish festivals.

On last night’s episode of The Daily Show with Jon Stewart on Comedy Central, correspondent Wyatt Cenac took up the ongoing debate in Westhampton Beach, Long Island as to whether to allow for an eruv (thin wire attached to existing electrical poles that gives the appearance that all the homes are within the same domain for carrying on Shabbat). The secular Jews of this town object to the erection of an eruv as they believe it will turn their town over to an Orthodox Jewish majority as has happened in other locales.

The segment is humorous, but also tainted with the type of infighting and vitriol that Samuel Freedman wrote about in his book, Jew vs. Jew: The Struggle for the Soul of American Jewry .

On Jewish Identity

I was one of three Jewish educators asked to respond to a statement about Jewish identity for this month’s issue of Sh’ma: A Journal of Jewish Responsibility. The statement was co-written by Patrick Aleph and Michael Sabani, the co-founders of Punk Torah. After I responded to their statement in writing, Patrick and Michael interviewed me via Skype. Their statement, my response and the video interview are below:

“If I try to be like him, who will be like me?” (Yiddish Proverb)

No study has ever been done to discover the root cause of why people stop identifying with Judaism. If we worry less about Judaism as a culture and more about monotheism, we might find that — suddenly — people have something more to believe in. Jewish identity is more than matzah ball soup and Young Professionals mixers.

God, Israel (the people), and the Torah are essential for Jewish identity. Without God, we sit on a stool with only two legs. Theists need to summon up the courage to put God first in Jewish life in spite of the urge to keep our heads down so we don’t look crazy.

We often place a lot of importance on not standing out, especially in a “tribal” sense. It gives us a sense of being a part of something larger than ourselves. The flip side is that if we all try to be like someone else, we lose who we really are.

Judaism is a path (halakhah) that allows us to walk together, even if we walk at our own pace. When we try to be like another, we are giving up our God-given individuality.

My response: 
Jewish identity is a tricky subject. We have no consensus on how to define it, what it should feel like, or to what extent it should be particularistic. I find that Judaism has much wisdom to offer, both to adherents of the faith and to the rest of the world. I’m often, therefore, baffled by our numbers — that we account for such a small fraction of the population.

Should we worry more about monotheism, as Michael Sabani and Patrick Aleph suggest? Should we worry less about the cultural components of our peoplehood? These are decisions that each individual “member of the tribe” must make. Some Jews will be enthralled with bagels and lox on Sunday mornings, federation meetings, Seinfeld reruns, and B’nai Brith softball. Other Jews will recharge their spiritual batteries in traditional synagogue life. Some will look to Jewish summer camp as their source of Jewishness, and for other people it will be the connection to the State of Israel. We are a club, but we’re not sure who is included and who decides our boundaries. It is good for us to stand out as tribally different, but we should also count our blessings that we are included in the larger fabric as well.

Gabby Giffords and Patrilineal Descent When It’s Desirable

As a Conservative rabbi and a member of the Rabbinical Assembly, I cannot officially consider Jewish descent to be determined patrilineally (from the father). In fact, in its “Code of Professional Conduct,” the section detailing the responsibilities for membership in the Rabbinical Assembly lists four current standards of religious practice. The first is: “Matrilineality determines Jewish status.”

And yet, like many Jews who regard Jewish status to require a Jewish mother or proper conversion, I admit to feeling pride when a Jewish athlete or celebrity is successful, even if their “Jewishness” isn’t technically defined by halachic standards. After all, when major league baseball player Ryan Braun won the National League Rookie of the Year award in 2007, should the Jewish community have refused to claim the “Hebrew Hammer” as one of our own since only his father is a “Member of the Tribe?” Braun considers himself to be Jewish and his Israeli-born father lost most of his family in the Holocaust.

The 1983 decision by the Reform Movement to recognize Jewish status by either the mother or the father continues to raise questions for the other streams of Judaism. The debate over “Who is a Jew” is back in the headlines following the shooting in Tucson, Arizona that critically injured Rep. Gabrielle Giffords. For Giffords, the daughter of a mother who is a Christian Scientist and a father who is Jewish and the grandson of a rabbi, there is no question of her Jewishness. She is a proud Jew who is an active member of her Reform congregation. She was married under a chuppah (wedding canopy) by a rabbi, albeit to a non-Jewish man.

This week, as Giffords lay in a hospital recovering from being shot in an assassination attempt by a domestic terrorist, her Hebrew name has circulated the world to be used in the traditional Mi Sheberach prayer for healing. Some rabbis have even questioned whether her non-Jewish mother’s name should be part of her Hebrew nomenclature for the prayer, while others have referred to her as Jewish but added the caveat “not halachically speaking.” Giffords co-chaired the Jewish Outreach Institute’s 2007 conference and is active in her congregation. Yesterday, President Barack Obama called Rabbi Stephanie Aaron, Giffords’ rabbi at Congregation Chaverim, to offer his prayers for a speedy recovery for the congresswoman.

Since Saturday’s shooting, we’ve learned quite a bit about Gabrielle Giffords and her Jewish pride. Her paternal grandfather, the son of a Lithuanian rabbi, changed his name to Giff Giffords for anti-Semitic reasons. On her campaign website, Giffords wrote, “Growing up, my family’s Jewish roots and tradition played an important role in shaping my values. The women in my family served as strong role models for me as a girl. In my family, if you want to get something done, you take it to the women relatives! Like my grandmother, I am a lifetime member of Hadassah and now a member of Congregation Chaverim. When I served in the State Senate in Arizona, I had the opportunity to visit Jerusalem. It was one of the most memorable experiences of my life. I will always be a strong supporter of Israel. As the only functioning democracy in the Middle East, Israel is a vital strategic ally of the United States. As a woman and as a Jew, I will always work to insure that the United States stands with Israel to jointly ensure our mutual safety, security, and prosperity.”

The Jerusalem Post was the first publication to state emphatically that Giffords’ Jewishness shouldn’t be questioned. In fact, in their editorial “Learning Judaism From Giffords,” they wrote, “With all our desire for a universally accepted definition of ‘Who is a Jew?’ that would unify the Jewish people, we cannot ignore the complicated reality that many ‘non-Jews’ are much more Jewish than their ‘Jewish’ fellows. Congresswoman Giffords is one of them.”

In her “In the Mix” blog at The Jewish Week, Julie Wiener wrote of how Giffords’ Jewishness is shining a spotlight on the “who is a Jew” debate. In her article, “Plight of the Patrilineals,” Weiner cited blogger “Kung Fu Jew,” who posted his angry rant on the JewSchool blog about how Giffords is “Jewish enough for the Jewish community to own a side-show of the media circus. Jewish enough to be our martyr, it seems, but not Jewish enough to be treated equally in life.” He has a point here. I’m sure many synagogues will offer prayers of healing for Rep. Giffords this Shabbat and recognize her as a Jewish member of Congress, yet they would be violating their own religious policy if they ever called her to the Torah for an aliyah honor.

I really wish we had a consensus on what determines Jewish status through lineage, even if only in the non-Orthodox Jewish community. Certainly, we cannot continue to make an exception for athletes, celebrities, and politicians of Jewish patrilineal descent. I’m in agreement with the Jerusalem Post on this matter. If Rep. Gabrielle Giffords considers herself Jewish because her father is Jewish and she lives a Jewish life, then she’s Jewish.

May Rep. Gabrielle Giffords (Gavriela bat Gloria v’Spencer) be granted a speedy and complete recovery.
